THE AMERICANS WITH DISABILITIES ACT

EFFECTIVE JANUARY 26, 1993 ALL PLACES OF "PUBLIC ACCOMMODATIONS" AND "COMMERCIAL FACILITIES" WITH LESS THAN 10 EMPLOYEES AND REVENUES LESS THAN $500,000 MUST COMPLY WITH THE AMERICAN'S WITH DISABILITIES ACT SIGNED BY PRESIDENT GEORGE BUSH, JULY 26, 1990. THIS LAW PROVIDES CIVIL RIGHTS TO OVER 43 MILLION AMERICANS WITH DISABILITIES.

WHAT DOES THIS ACT COVER?

The act provides comprehensive civil rights protection to individuals with disabilities in five areas.

TITLE I   Employment

TITLE II   Public services and transportation

TITLE III   Public accommodation & commercial facilities

TITLE IV   Telecommunications

TITLE V   Miscellaneous

TITLES II AND III REQUIRES SPECIAL ADA SIGNAGE IN THE FOLLOWING PLACES OF "PUBLIC ACCOMMODATIONS" AND "COMMERCIAL FACILITIES":

a)  an inn, hotel, motel, or other places of lodging except for an establishment located within a building that contains not more than five rooms for rent or hire and that is actually occupied by the proprietor as residence of such proprietor;

b)  a restaurant, bar or other establishment serving food or drink;

c)  A motion picture house, theater, concert hall, stadium or other place of exhibition or entertainment.

d)  an auditorium, convention center, lecture hall or other place of public gathering;

e)  a bakery, grocery store, clothing store, hardware store, shopping center or other sales or rental establishment;

f)  a laundromat, dry cleaner, bank, barber shop, beauty shop, travel service, show repair service, funeral parlor, gas station, office of an accountant or lawyer, pharmacy, insurance office, professional office of a health care provider, hospital, or other service establishment;

g)  a terminal depot or other station used for a specified public transportation;

h)  a museum, library, gallery, or other place of public display or collection;

i)  a park, zoo, amusement park or other place of recreation;

j)  a nursery, public or private schools or other places of education;

k)  a day care center, senior citizens center, homeless shelter, food bank, adoption agency or other social service center establishment;

l)  state universities, local, state governmental agencies;

m)  office buildings, factories and warehouses.

BE AWARE

Facilities not in compliance are subject to federal penalties. Facilities unable to achieve full compliance may be able to avoid enforcement by showing a "good faith" effort towards compliance.

The special ADA signage is considered "readily achievable" under the new law which means it is one of the least expensive and most expedient ways to establish a "good faith" effort towards compliance.
